Proposed Conditions for Granting Mining Permits
The Ministry of Natural Resources and Environment is requesting public input on a draft Decree outlining the updated requirements for obtaining a mining permit in Vietnam. The Decree clarifies provisions within the recently passed Law No. 54/2024/QH15 on Geology and Minerals, replacing the 2010 Mineral Law and effective July 1, 2025. The new law introduces significant changes across various areas, including mineral resource management and exploitation. To secure a mining permit, organizations and individuals must meet several conditions: selection by a competent state agency or winning a mining rights auction; fulfilling requirements for mineral exploitation practices; demonstrating sufficient financial capacity to execute the proposed project; and submitting a comprehensive application package. This application includes documents such as an application form, mining area map, approved investment project, environmental impact assessment report, design drawings, and safety assessments for radioactive ore exploitation. The Decree also outlines conditions for permit relinquishment, allowing organizations and individuals to return their permits if they no longer require them, have met their obligations, and submitted the necessary application.
